That may be the case, but that is their choice.  Two-letter TLDs are designated country code TLDs, and their assignment is based on an international standard (ISO 3166-1).  Conflicts between OpenNIC and ICANN designations may very well exist from time to time.  However, I see no good reasons to intentionally introduce a conflict with IANA-designated ccTLDs as is being proposed here.
