Legal issues aside, it's probably best to yield to ICANN. If not, there
becomes a disincentive for end users to use OpenNIC.

In the long run, maybe we create a TLD that ICANN would not take, like
".opennic". We could define 2LDs like free.opennic and offer registrations
of the 3LDs.
