Brian,
I think you are right.  Other groups, such as Name.space 
(https://rally.org/namespace)  have always had a legal body to stand on; 
and have used it.  This is a great community, of which I have faded in 
and out of over the last 10 years, but have always kept in my list of 
DNS servers -- not for the actual content, or domain names offered, but 
because it's community-run and under its own authority.
