This is a good point -- The last thing I want to do is create additional hurdles and uncertainties for someone wanting to register and use a .cyb domain, so I think it might be sensible to get rid of the commercial use clause.
On a side note, I noticed the .geek TLD charter has a similar restriction on commercial use to the one we proposed for .cyb: https://wiki.opennic.org/opennic:dot:geek
I'd be interested to hear the rationale for this.

to the idea of dropping the whole thing and allowing commercial use, and
